Terms of service
Last updated: 10 September 2026 · Draft pending legal review
1. What these terms cover
These terms govern your use of this website and describe the basis on which Edukable ("we", "us") provides marketing services to EdTech companies. A signed proposal or statement of work always takes precedence over the summary below.
2. The services
Edukable provides end-to-end marketing operations: discovery (SEO, content), demand (paid advertising, demand generation, social media), conversion (CRO, website design), lifecycle (email marketing, retention), operations (marketing automation, analytics) and positioning (brand strategy). The exact scope of an engagement is defined in the proposal, not on this page.
3. Pricing and engagement
- Monthly retainers range from $6,000 to $18,000 depending on scope, channels and stage.
- A one-time paid diagnostic is available for companies not ready for a retainer.
- Media spend on paid platforms is paid by the client directly to the platforms and is separate from fees.
- Invoices are issued monthly and payable per the terms of the proposal.
4. What we do not promise
We do not guarantee rankings, revenue, lead volume or timelines. Marketing outcomes depend on factors outside our control, including your sales cycle, which in EdTech typically runs three to nine months. We commit to the work, the reporting and the standard of care, not to a number.
5. Your responsibilities
- Accurate information about your business, product and pipeline.
- Timely access to the accounts, tools and approvers the work depends on.
- Compliance of your product and claims with the regulations of your markets (COPPA, FERPA, GDPR and others) remains yours; we flag marketing-side risk when we see it.
6. Intellectual property
On full payment, the deliverables created specifically for you (copy, designs, configured workflows) are yours. Our methods, templates, the EdukableOS framework and anything built before or outside your engagement remain ours. Either side may describe the relationship publicly unless the proposal states otherwise; named case studies and figures are published only with your written approval.
7. Confidentiality
Information exchanged in the course of an engagement is confidential to both parties and used only for the engagement, except for the free audit, which is provided without an NDA and contains only observations derivable from public or first-party data you share.
8. Liability
To the extent permitted by law, our aggregate liability under an engagement is capped at the fees paid under that engagement in the preceding three months. We are not liable for indirect or consequential loss, including lost revenue or lost enrolments. Nothing in these terms limits liability that cannot lawfully be limited.
9. Ending an engagement
Either party may end an engagement with 30 days' written notice unless the proposal states otherwise. Fees earned and committed third-party costs up to the end date remain payable.
10. Governing law
These terms and any engagement are governed by the laws of the jurisdiction in which Edukable is incorporated, without regard to conflict-of-law rules.
11. This website
Content on this site is general information about our services, not advice. Figures shown carry their scope, period and source where published; illustrative structures are labelled as such. Links to third-party sites are not endorsements. If any part of these terms is found unenforceable, the rest continues to apply.
